These Terms and Conditions (“Terms”) govern your use of kaizenhq.ai (the “Site”), operated by KaizenHQ LLC (“KaizenHQ,” “we,” “us,” or “our”). By using the Site or submitting a form, you agree to these Terms. Our Privacy Policy describes how we collect and use personal information and is incorporated by reference.

1. Services

KaizenHQ provides business consulting, revenue-leak audits, and related optimization services for service businesses. The free audit at /audit is an informational lead magnet. Paid engagements are governed by separate written agreements.

2. SMS messaging program

If you provide a mobile phone number and separately check the SMS consent checkbox on our audit form or contact form, you may receive text messages from KaizenHQ, including:

• Notifications when your revenue-leak audit report is ready to view;
• Follow-up and nurturing messages related to your audit or contact inquiry;
• Appointment confirmations and reminders for calls with KaizenHQ; and
• Other service-related updates you reasonably expect from a business you contacted.

Consent is never bundled. Checking the SMS box is optional and is not required to submit a form, receive email, or use the Site. The checkbox is unchecked by default. You must affirmatively opt in before we send any SMS.

Message frequency varies. You may receive no messages in a given month, or occasionally one or more during an active conversation. Message and data rates may apply.

Opt-out and help: Reply STOP to any message to cancel all KaizenHQ SMS. Reply HELP for assistance or email support@kaizenhq.ai.

3. Mobile information — not shared for marketing

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services necessary to deliver SMS (such as our messaging carrier).

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All other categories of data exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell or rent your phone number or SMS consent records to lead generators, affiliates, or other marketers. See our Privacy Policy for full detail on subprocessors that help us operate the Site and deliver messages.

4. Acceptable use

You agree not to misuse the Site, submit false information, attempt unauthorized access, or use automated means to scrape or overload our systems. We may suspend access for abuse.

5. Disclaimers

Audit results and materials on the Site are for informational purposes. They are not a guarantee of revenue outcomes. The Site is provided “as is” without warranties of any kind, to the fullest extent permitted by law.

6. Limitation of liability

To the maximum extent permitted by law, KaizenHQ LLC and its officers will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or SMS program. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100) unless a higher amount is required by applicable law.

7. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Wyoming, unless otherwise required by law.

8. Changes

We may update these Terms by posting a revised version on this page and updating the effective date. Material changes to the SMS program will be reflected here and, where appropriate, in our form consent language.
